Privacy Policy
Foyer is a Calgary-based lead-generation brand that connects qualified buyers with independent buyer's agents for presale and new-construction condos. This policy explains what personal information we collect when you use our website, why we collect it, who we share it with, and the rights you have under Canadian privacy law.
1. Who we are
"Foyer," "we," "our," and "us" refer to the operator of foyer.ca and any sub-domains (the "Site"). We are based in Calgary, Alberta, Canada. Foyer is not itself a real-estate brokerage and we are not licensed under the Real Estate Council of Alberta. We collect contact details from buyers who are interested in pre-construction condos in Calgary and connect them with independent buyer's agents who are licensed to provide real-estate services.
We are subject to the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and the Personal Information Protection Act (PIPA) of Alberta. Marketing emails we send are governed by Canada's Anti-Spam Legislation (CASL).
2. What we collect
We collect only the information we need to do what you've asked us to do.
Information you give us directly
| Type | What it includes |
|---|---|
| Contact details | First name, last name, email address, phone number. |
| Quiz responses | Buyer type, motivation, purchase timeline, budget range, unit preference, whether you're buying solo or with a partner, mortgage status. |
| Consent record | Whether you opted in to marketing communications (CASL consent). |
Information collected automatically
| Technical data | IP address, browser type, device type, operating system, referring URL, and the timestamp of your form submission. We use this to verify your consent record and to defend against spam and abuse. |
| Campaign attribution | If you arrived via an advertisement or tracked link, we read UTM parameters (e.g. utm_source, utm_campaign) from the URL so we can measure which campaigns are working. |
| Funnel events | Anonymous events such as "viewed step 1," "started quiz," "submitted form" — sent to Meta (Facebook) via the Meta Pixel. See Cookies, pixels, and analytics. |
3. Why we collect it
We use your information for the following purposes:
- To deliver the service you requested — to contact you, qualify you, and connect you with an independent buyer's agent who is licensed in Alberta.
- To improve the funnel — to understand which steps people complete, which they drop off at, and which marketing channels send qualified leads.
- To meet our legal obligations — to maintain an auditable record of your CASL consent (including the IP address and timestamp of your opt-in), and to comply with any other applicable law.
- To protect the Site — to detect spam submissions, fraudulent contact attempts, and abusive behaviour.
We do not use your information for automated decision-making that has a legal or similarly significant effect on you. We do not sell your information to anyone, ever.
4. Who we share it with
We share your information with the following parties, and only for the purposes described:
The independent buyer's agent we connect you with
When you complete the form and consent to be contacted, we hand off your contact details, quiz responses, and lead profile to a licensed buyer's agent in Calgary so they can introduce themselves and help you with your purchase. The agent is an independent business and will be subject to their own privacy practices, which they will share with you on first contact.
Service providers ("data processors")
| Provider | Purpose |
|---|---|
| Vercel | Hosts the website and the small server function that receives your form submission. Vercel temporarily processes your data in transit and writes operational logs. |
| GoHighLevel (HighLevel) | Acts as our customer-relationship-management (CRM) system. Your contact details, quiz responses, and consent record are stored in GoHighLevel so we can manage your inquiry and route it to the right agent. |
| Meta Platforms (Facebook) | If you arrived from a Facebook or Instagram ad, or if our Meta Pixel is loaded on the page you visit, anonymous engagement events are sent to Meta so we can measure ad performance. See section 5 for what you can do about this. |
| Google Fonts | Serves the typefaces used on the Site. Google receives your IP address as a normal consequence of loading any third-party CDN resource. |
Legal and safety disclosures
We may disclose information if we are required to by Canadian law, by a valid legal order from a court of competent jurisdiction, or to protect the rights, property, or safety of Foyer, our users, or the public.
5. Cookies, pixels, and analytics
The Site uses a small amount of browser storage and a third-party tracking pixel:
- Local storage: we temporarily store an unsent form payload on your device so that, if your network connection drops during submission, your details are not lost. This data lives only on your device and is cleared once your form successfully reaches us.
- Meta (Facebook) Pixel: a JavaScript tracker provided by Meta Platforms. The Pixel sets cookies in your browser and reports anonymous events (page view, quiz start, form submission) to Meta so we can measure the performance of Facebook and Instagram advertising and build look-alike audiences.
6. Marketing emails and CASL consent
Canada's Anti-Spam Legislation (CASL) requires us to obtain your express consent before sending you a commercial electronic message (a "CEM"). When you tick the consent box at the bottom of the form, we record:
- The fact that you opted in;
- The date and time of the opt-in (in UTC);
- The IP address from which the opt-in was submitted.
You can withdraw consent at any time, free of charge, by clicking the "Unsubscribe" link at the bottom of any marketing email we send, or by emailing CONTACT_EMAIL. We will action withdrawal requests within ten (10) business days, as required by CASL.
Once you have been connected with a buyer's agent, any further commercial messages from that agent are subject to the agent's own CASL practices. The agent should make first contact by phone, or should obtain their own CASL consent from you before sending CEMs.
7. How long we keep your information
| Information | Retention |
|---|---|
| Active leads (in GoHighLevel) | Up to 24 months from the date of submission, unless you ask us to delete sooner. |
| CASL consent record | At least 3 years from the date of opt-in or last opt-out, as required for CASL audits. |
| Server logs (IP, request metadata) | Up to 30 days, then automatically purged by our hosting provider. |
| Aggregated analytics | Indefinitely, but only in aggregated, non-identifying form. |
8. How we protect your information
We take reasonable, industry-standard technical and organisational measures to safeguard your information:
- All traffic between your browser and the Site is encrypted in transit using HTTPS (TLS).
- The webhook URL that delivers your data to our CRM is stored as a server-side environment variable and never appears in client-side code.
- Our form receiver applies a per-IP rate limit to deter automated abuse.
- Access to our CRM is restricted to authorised personnel and the buyer's agent assigned to your inquiry.
No method of transmission or storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security.
9. Your rights and choices
Under PIPEDA and Alberta PIPA, you have the right to:
- Access the personal information we hold about you and ask for a copy;
- Correct information that is inaccurate or incomplete;
- Withdraw consent for any use that depends on consent (subject to legal or contractual restrictions);
- Delete your information, subject to our legal retention obligations (notably the CASL consent record);
- Complain to a privacy regulator if you believe we have mishandled your information. In Canada, that's the Office of the Privacy Commissioner of Canada. In Alberta, that's the Office of the Information and Privacy Commissioner of Alberta.
To exercise any of these rights, email us at CONTACT_EMAIL. We will respond within thirty (30) days as required by PIPEDA, or sooner where required by PIPA.
10. Where your information is stored
Foyer is based in Canada, but some of the service providers we use (notably Vercel and Meta) may store or process your information on servers located in the United States or in other countries. When information is stored outside Canada, it may be subject to the laws of that jurisdiction, including lawful-access requests by foreign governments or courts. By using the Site and submitting the form, you consent to this transfer.
We have selected providers with strong privacy track records and with contractual safeguards in place where available.
11. Children
The Site is not directed at, or intended for use by, individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected information from a minor, please contact us so we can delete it.
12. Changes to this policy
We may update this policy from time to time. The "Effective" date at the top of the page indicates the current version. If we make material changes that affect how we use your information, we will take reasonable steps to notify you — for example, by posting a notice on the Site or by emailing you at the address you provided.
